Governing Jurisdiction: State of Texas
1. Acceptance of Terms & Operational Authority
By accessing this website, scheduling aircraft detailing services, utilizing our digital management portals (including AirportSync), or executing a hangar sublease/management agreement with Guardian Aviation Services, LLC or its subsidiaries, you ("Client," "Tenant," or "User") agree to be bound by these Terms and Conditions.
Guardian Aviation Services operates under a strict mandate: "We cover your assets. You focus on flight." To maintain absolute safety, operational discipline, and asset protection across our facilities, all services rendered and facility accesses granted are subject to the rules detailed herein.
2. Digital Portals, Scheduling & The "2-Hour Rule"
All staging, pull-out, put-away, and service requests for aircraft housed within Guardian-managed facilities must be processed through our authorized digital dispatch system (AirportSync) or dedicated operations line.
-
Mandatory Lead Time: Clients must provide a minimum of two (2) hours' advance notice for all aircraft staging requests. This operational buffer allows our ground team to safely execute spatial nesting ("Hangar Tetris") when needed without risking airframe contact.
-
The "No-Touch" Protocol: Tenants and third parties are strictly prohibited from moving, towing, or physically repositioning any aircraft other than their own within Guardian-managed facilities. All ground movements are executed exclusively by trained Guardian personnel.
-
Website Security: This digital platform is secured with enterprise-grade 256-bit SSL encryption. User accounts, flight schedules, and corporate flight department telemetry are protected under strict confidentiality protocols.
3. Detailing Standards & Chemical Compliance
All detailing services executed under Guardian Aviation Services or Prop Wash Aviation Services adhere to rigorous aerospace manufacturing guidelines.
-
AMS 1526 & OEM Compliance: We exclusively deploy chemical cleaners, polishes, and sealants certified under SAE AMS 1526 and Boeing D6-17487 standards. This ensures total protection against aluminum corrosion, rivet degradation, and plexiglass/acrylic crazing.
-
Windscreen Protocol: Mechanical polishing of aircraft windscreens and cabin windows is conducted strictly at low RPMs using specialized optical compounds to prevent friction heat, optical distortion, or "lens effects."
-
Belly Degreasing & Solvent Standards: Standard fleet packages include comprehensive belly degreasing to remove hydraulic fluid (Skydrol, 3606, etc.) and exhaust soot. Hazardous fluid disposal is executed in compliance with local municipal airport environmental standards, EPA guidelines, and TCEQ mandates.
4. Billing, Management Fees & Payment Terms
Guardian Aviation Services enforces rigid financial governance to protect asset yields and operational predictability.
-
Hangar Rent & Recurring Invoices: Monthly hangar rent and recurring facility service fees are strictly due on the 1st of each calendar month.
-
Late Fee Structure: Any account balance remaining unpaid past 5:00 PM CST on the 5th of the month will automatically incur a non-negotiable $60.00 late fee.
-
Hangar Management Fees: Pursuant to our commercial management agreements, Guardian Aviation Services retains a 20% management fee on gross rents collected for managed facilities, remitting net yields monthly to facility owners.
-
Annual Agreement Draw-Downs: Pre-paid funds for annual service agreements, lease agreements, or other contracts are deposited into a dedicated account and drawn down per service executed or incremental time passed. Individual service or incremental (monthly) invoices will be issued showing a $0.00 Balance Due (Paid by Credit).
5. Statutory Remedies & Texas Hangar Keeper's Liens
Non-payment of detailing invoices, facility care fees, or hangar rent triggers immediate statutory enforcement under the laws of the State of Texas.
-
Texas Property Code Chapter 70 Enforcement: Under Chapter 70 of the Texas Property Code, Guardian Aviation Services maintains statutory Hangar Keeper’s Lien rights against any aircraft, equipment, or personal property serviced or stored within our managed facilities for unpaid fees, labor, or storage charges.
-
Lockout & Detention Rights: In the event of monetary default past the 10th of the month, Guardian Aviation Services reserves the legal right to deny facility access, suspend digital staging protocols, and physically detain the aircraft or property until all outstanding balances, late fees, and legal expenses are satisfied in full. All rents will continue to accrue until the account is settled in full at which point access status will be restored or an order to vacate issued.
6. Insurance & Liability Insulation
To ensure maximum risk separation, all clients and sub-tenants must adhere to our mandatory insurance verification loop before bringing assets into a Guardian-managed facility.
-
Tenant Insurance Mandate: All hangar sub-tenants and long-term service clients must maintain active Aircraft Hull and Liability insurance. Guardian Aviation Services, LLC and the specific Facility/Hangar Owner must be named as Additionally Insured with a formal Waiver of Subrogation on file. If the client's insurance company charges a fee for maintaining a Waiver of Subrogation, Guardian may, at its sole discretion, agree to pay the fee on behalf of Guardian and the Hangar Owner.
-
Hangarkeeper's Liability: Guardian maintains specialized Hangarkeeper’s Liability and Commercial General Liability coverage protecting assets while under our direct physical care, custody, and control.
-
Third-Party Mechanics: Unvetted third-party mechanics or contractors are prohibited from performing heavy maintenance inside Guardian hangars without prior written authorization, proof of insurance, and an executed hold-harmless agreement.
7. Facility Standards & Environmental Compliance
Clients utilizing Guardian Aviation Services facilities agree to uphold a showroom-grade environment:
-
Drip Pans: All aircraft parked inside a Guardian facility must utilize approved drip pans under engines and gear. Guardian will provide one 35x23" drip pan for each aircraft. Additional pans must be purchased by the aircraft owner if required to mitigate spills or leaks.
-
Prohibited Items: Storage of open flammables, fuels, hazardous chemicals, household furniture, or non-aeronautical junk is strictly prohibited.
-
Spill Remediation: Accidental fluid spills must be reported immediately. Guardian reserves the right to execute emergency chemical remediation at the asset owner's expense if an uncontained leak damages or threatens to damage concrete sealants or encroaches on airport storm drains.
8. Non-Sale of Data & Privacy
In accordance with our Privacy Policy, Guardian Aviation Services does not sell, rent, lease, trade, or distribute client, tail number, or flight schedule data to any third party. Telemetry gathered via our digital platforms or ADS-B tracking integrations is utilized strictly for logistics optimization, scheduling, and direct client communications.
